1.2 Definitions
- •"Service" or "Safekept": the mobile application for iOS, the companion application for Apple Watch, and all related backend services
- •"User": the natural person who downloads, installs, or uses the Service
- •"Session": the period of time during which the Service actively monitors the User's safety
- •"Check-in": the periodic notification sent to the User to verify their safety status
- •"Guardian": a person designated by the User as a trusted contact to receive safety alerts
- •"Escalation": the automatic process of notifying Guardians when check-ins are missed
2. Acceptance of Terms
By downloading, installing, or using Safekept, you agree to be bound by these Terms of Service and the Privacy Policy available at safekept.app/privacy. If you do not agree, do not use the Service and uninstall the application.
We may update these Terms. Material changes will be communicated at least 30 days in advance via email and in-app notification. Continued use after changes take effect constitutes acceptance. If you disagree, you may terminate by deleting your account.
3. Description of Service
SAFEKEPT IS NOT AN EMERGENCY SERVICE. IN CASE OF IMMEDIATE DANGER, ALWAYS CALL 112 (OR YOUR LOCAL EMERGENCY NUMBER). SAFEKEPT DOES NOT GUARANTEE THAT ALERTS ARE DELIVERED OR THAT ANYONE WILL RESPOND.
Safekept provides a personal safety monitoring service including:
- •Starting safety sessions with GPS location sharing
- •Sending periodic check-ins to verify User status
- •Automatic notification to designated Guardians when check-ins are missed
- •Real-time location sharing with Guardians during active sessions
- •Emergency button for immediate escalation
- •Session state synchronization with Apple Watch
Safekept is a communication and monitoring tool. The Service does NOT replace emergency services (112 (or your local emergency number), or local equivalents), does NOT guarantee User physical safety, and does NOT constitute a professional surveillance service.
Guardians are personal contacts chosen by the User, not professional operators or emergency-response services, and have no obligation to respond or act.
4. Eligibility Requirements
You must be at least 16 years old to create an account. You must provide a valid email address, phone number, and display name. Sign-in is via email and password or “Sign in with Apple” (in which case Apple may provide an anonymous relay email address). You are responsible for the accuracy of your information and the security of your account credentials.
5. User Responsibilities
5.1 Lawful use
- •Use the Service exclusively for personal safety purposes
- •Provide accurate and up-to-date information
- •Do not use the Service for stalking, harassment, non-consensual surveillance, or any unlawful purpose
5.2 Guardian management
- •Obtain prior consent from individuals before designating them as Guardians
- •Inform Guardians about the nature of the service and notifications they may receive
- •Do not add persons who have explicitly refused the Guardian role
- •Cancel false alarms promptly to avoid unnecessary distress
5.3 Prohibited activities
- •Reverse engineering, decompiling, or disassembling the application
- •Attempting to access other users' data
- •Using the Service to collect data on third parties without consent
- •Interfering with Service or infrastructure operation
- •Sharing your account with third parties
- •Using bots, automated scripts, or other unintended means
5.4 Messaging consent & opt-out
Messaging consent & opt-out. By adding a guardian, the user represents that they have a legitimate relationship with that person and may reasonably designate them as a safety contact, having informed them of the nature of the service. Actual consent to receive informational communications is given by the guardian themselves by accepting the invitation they receive (recorded with a timestamp); until then they receive only the invitation message. Any recipient can stop messages by replying STOP to an SMS, declining the invitation, or requesting removal; the stop is immediate. Safekept sends only transactional messages and never sends promotional or marketing messages via SMS.
6. Important Limitations and Disclaimer
Safekept cannot guarantee User physical safety. The Service is a complementary tool. Specifically:
- •We cannot guarantee notification delivery in all circumstances (network issues, device problems, etc.)
- •We cannot guarantee Guardians will receive, read, or act on notifications
- •We cannot guarantee GPS coverage or location accuracy in all environments
- •We do not control and are not responsible for Guardian actions or inactions
- •The Service depends on device battery, internet connectivity, and enabled location services
7. Limitation of Liability
To the maximum extent permitted by applicable law, the Service Provider shall not be liable for any direct, indirect, incidental, special, consequential, or punitive damages arising from the use or inability to use the Service, including personal injury, property damage, failed notification delivery, or Guardian actions/inactions.
These limitations do not apply insofar as they conflict with mandatory consumer protection provisions under applicable law. In any case, total liability shall not exceed any amount paid by the User for the Service in the 12 months preceding the event.
8. Intellectual Property
Safekept, its name, logo, design, user interface, source code, and documentation are the exclusive property of the Service Provider, protected by intellectual property laws. You receive a limited, non-exclusive, non-transferable, revocable license to use the application on your own devices for personal, non-commercial purposes only.
9. Suspension and Termination
We may suspend access to the Service for Terms violations, unlawful use, behavior that risks Service security, or at the request of judicial authorities.
You may delete your account at any time via app settings or by writing to privacy@safekept.app. Deletion results in removal of all personal data within 30 days, except data required by law to be retained.
10. Free Service and Business Model
The Service is currently offered free of charge. Core safety features (sessions, check-ins, guardians, escalation) require no payment. We may introduce optional premium features in the future while keeping core safety features free. The Service contains no advertising and does not use user data for advertising purposes.
11. Distribution Platforms
The application is distributed via Apple App Store. You acknowledge that Apple Inc. is not a party to this agreement, has no maintenance or support obligations regarding the Service, and that disputes should be directed to the Service Provider, not Apple.
12. Apple Watch
The Apple Watch companion app allows viewing active session status and quick check-in interactions. It works in conjunction with the iPhone (not independently) and requires a paired iPhone with Safekept installed.
13. Service Availability
We strive for high availability but do not guarantee uninterrupted service. We may perform scheduled maintenance (with advance notice where possible), temporarily suspend the Service for updates, or interrupt service due to force majeure.
14. Governing Law and Jurisdiction
These Terms are governed by Italian law and European Union law.
For consumers under Italian Consumer Code (D.Lgs. 206/2005): the court of the consumer's place of residence has jurisdiction. For non-consumers: the courts of Milan, Italy have exclusive jurisdiction.
EU consumers may use the Online Dispute Resolution platform: https://ec.europa.eu/consumers/odr
Nothing in these Terms prejudices mandatory consumer protection rights under applicable law.
15. General Provisions
- •Entire agreement: These Terms, together with the Privacy Policy, constitute the entire agreement between User and Service Provider.
- •Severability: If any provision is declared invalid, the remaining provisions remain in full force.
- •Assignment: You may not assign your rights without written consent. We may assign these Terms upon business transfer, with notice to you.
- •Force majeure: We are not liable for failures caused by force majeure events (natural disasters, network outages, government acts, pandemics, third-party provider failures).
